SCOTUS Deals Another Blow to Administrative State

July 2, 2024

The Supreme Court delivers yet another blow to the power of the administrative state, ruling 6-3 that the six-year window to sue federal agencies begins when the plaintiff experiences damages due to their actions (Corner Post v Board of Governors (July 1, 2024)). This effectively extends the statute of limitations, giving harmed plaintiffs more time in which to sue the federal agency that caused the injury.

Couple this with the end of Chevron Deference, and we are about to see a LOT of lawsuits brought against out-of-control regulatory agencies. This is a win for the People over the administrative state.
