Episode 238: When Doctors Become the Target

What happens when a physician who spent the pandemic on the front lines of patient care finds himself in the crosshairs of federal prosecutors?

This week on VSRF Live, emergency physician Dr. Ron Elfenbein joins us to discuss the extraordinary legal battle that has upended his life. During the COVID-19 pandemic, Dr. Elfenbein established one of Maryland's busiest monoclonal antibody infusion centers and became a national advocate for early treatment. After witnessing remarkable outcomes in high-risk COVID patients treated with monoclonal antibodies, he publicly criticized the federal government's decision to restrict access to those therapies.

Just months later, federal prosecutors charged Dr. Elfenbein with five counts of healthcare fraud over the billing codes his medical practice used during thousands of COVID testing visits. Although a jury convicted him on all five counts, the trial judge set aside the verdict and entered a judgment of acquittal, ruling that the government had failed to prove criminal fraud beyond a reasonable doubt and that the billing guidance was sufficiently ambiguous to support Dr. Elfenbein's interpretation.

Rather than ending the case, the government appealed. The American Medical Association and the Maryland State Medical Society filed a friend-of-the-court brief supporting Dr. Elfenbein, arguing that the coding guidance at the center of the prosecution was far from clear and that criminal liability should not rest on ambiguous billing standards. He now faces another federal trial.
